That's because he was under mistaken idea that he wasn't on your land. He believed your neighbors. I believe your only recourse is to sue your neighbors for lost rent. I'd just let it die. He may get one more cutting-small one at that.
The farmer knew the land was in dispute. He testified in Court. I called him after he cut the alfalfa down and told him the Judge's order, reminding him going on our property the next time would be trespassing. What is to be mistaken about? He made the deliberate choice to take the hay.

Until he gets court ruling, guess he doesn't believe you. When you get it, do what you want. I'd still give him a termination notice in writing. Until then it's your word against your neighbors. Most farmers I know would just abandon your strip. Curious is his full time job farming or is he a weekend warrior?

Not exactly week end. He's baling during the day, but has a off farm job as well.

How do you terminate someone who says in court that he has no contract or verbal agreement to harvest my land?

In AG, it is implied once you plant or work the ground that it is yours for that year. I'm under the impression when he stated that in court, he had agreement with your neighbor and disputed ground (he assumed incorrectly) belonged to your neighbor. So he would have no agreement with you-he didn't see need for it. Then again, he might just be a giant jerk.

I'd state in letter that court ruled in your favor. The surveyor has marked the boundaries clearly. He has no permission to be on your ground. I would allow him to finish out the year or until I put up new fence. IF he complains about the seeding, fertilizer, lime, etc, tell him sweetly, need to take that up with neighbor who rented you MY ground. IF he threatens to kill it, then inform him that is vandelism and appropriate authorities will be called.

IF you want to rent to him (I wouldn't) that he can contact you or your contact person.

He knew (I told him) that he case had been resolved. He knew he was trespassing when he went on the property. He didn't realize I would call it theft, and laughed at the trespassing charge he knew the police wouldn't press.

I vote for jerk. Not giant, but jerk nonetheless. I don't expect him to go any further than the neighbor tells him to go unless I try pressing charges against him. I believe that would stop him from further action on my property. I didn't mention his name to the officer who stopped by. Until he removed the hay I had no problem with him.

When court order is finalized, they will have no choice but to obey the law. Which means filing trespassing charges along with theft. My guess is they will talk to hay baler, explain what they will be forced to do, then talk to you. Baler will stay off and you won't press charges.

From what you have stated, court decision is in but until lawyers finalize, it isn't done. Stinking lawyers.....

New (non) confrontation with neighbor. DH, Gypsy, and I were putting in temporary fence posts and string for approx. boundary. Still within our property but partly where the neighbor has been working and mowing. Then we were cleaning out that area.

The neighbor told us we had to wait for the surveyors before working in the (no longer) disputed land. I told him he could wait. I knew were the boundary lines ran; he didn't. He started yelling so DH and I walked away with some comment about not arguing with idiots. Neighbor's parting shot was "then you must talk to yourself a lot."

Thank you, sir! Sure, I do, 'cuz I'm not an idiot. I even to idiots from time to time, it's just not worth arguing with them. Wouldn't it be nice if loud-mouthed hot-heads actually understood the language and knew how to use it?
