I belong to a homesteading group on FB and this plant has really started a debate. Took me about 8 posts to convince them it is NOT a type of nightshade. (I guess here in the Pacific Northwest bittersweet nightshade is called deadly nightshade...:th)
Anyhoo, this is a 15-20' shrubby tree, not sure of flower color:

I was thinking it was Yaupon Holly, but we are too far North (zone 6) according to most of what I have read and it is deciduous. Could it be a cultivar?
Prunus virginiana and Prunus emarginata have been suggested but the berries don't look right for the first and the leaves don't look right for the second. To me anyways...:hu
Guessing I am wrong, any ideas?
(edit to add: Birds do not eat the fruit.)
