I've had those horses before! They barely stumble along unless the gate opens and they can get out on the ROAD!! WHOO-HOO!!!! RUN!!!
Never a horse, but a few dogs that would disappear from the yard every time the wind would blow gate open or someone forgot to shut it!

If your livestock is on the road and someone hits one, you are held liable for any damage or injury. Livestock on the road is a major concern, I have chased down horses that aren't even mine before, caught them and then found the owner. Cattle are another story. Most people drive on by, but others will stop and flag traffic until the cattle can be gotten off the road.
